Terms of Use

The rules governing your use of our website and participation in the TMTP programme.

By accessing this website or submitting an enrolment application, you agree to these Terms of Use in full. If you do not agree, please do not use this website or enrol in the programme.

1. About TMTP

The Transforming Minds Tutoring Programme (TMTP) is a non-profit educational initiative based in Cape Town, South Africa. We provide tutoring services to students in Grades 8–12 and post-matric learners in the Western Cape.

These terms govern: (a) your use of the website at www.transformingmindstus.co.za; and (b) your participation in the TMTP programme as a student, parent, guardian, or tutor.

2. Eligibility

Our tutoring programme is open to:

  • Students currently enrolled in Grade 8 through Grade 12 in South Africa.
  • Post-matric learners seeking academic support.
  • Students primarily located in or able to travel to Cape Town (Delft South or Langa).

Students under the age of 18 must have a parent or guardian submit the enrolment application or provide documented consent. By submitting an application for a minor, the adult confirms they have parental authority to do so.

3. Enrolment and Placement

Submission of an enrolment application does not guarantee acceptance into the programme. TMTP reserves the right to accept or decline applications based on capacity, eligibility, and programme suitability.

Upon acceptance, students will be contacted within 2–3 business days with confirmation and scheduling details. TMTP reserves the right to adjust session times, locations, and tutor assignments as necessary.

4. Programme Rules and Expectations

All participants are expected to:

  • Attend sessions punctually and notify TMTP at least 24 hours in advance if unable to attend.
  • Treat tutors, fellow students, and TMTP staff with respect at all times.
  • Comply with the rules of the venue (library or other facility) where sessions take place.
  • Refrain from disruptive, violent, discriminatory, or otherwise harmful behaviour.
  • Not use programme time for activities unrelated to academic support.

TMTP reserves the right to suspend or permanently remove any participant from the programme for behaviour that violates these expectations or our Code of Conduct.

5. Website Use

5.1 Permitted use

You may use this website for lawful purposes only — including browsing programme information, submitting an enrolment application, and reading published content.

5.2 Prohibited conduct

You must not:

  • Introduce malware, viruses, or any malicious code.
  • Use automated tools to scrape, crawl, or harvest content or data from the site.
  • Impersonate TMTP, its staff, or any other person.
  • Post or transmit any unlawful, defamatory, harassing, or offensive content.
  • Use the website or programme for any commercial purpose without written permission.

6. Intellectual Property

All content on this website — including text, images, logos, graphics, and programme materials — is owned by or licensed to TMTP and is protected by South African copyright law. You may not reproduce, distribute, adapt, or republish any content without our prior written consent, except for personal, non-commercial use.

The TMTP name, logo, and associated marks are the property of the Transforming Minds Tutoring Program. Nothing on this website grants you any right to use them.

7. Disclaimer of Warranties

This website and the information it contains are provided on an "as is" basis without any warranties of any kind, express or implied. TMTP does not warrant that the website will be uninterrupted, error-free, or free of viruses or harmful components.

While we strive to ensure academic support is of a high standard, TMTP does not guarantee any specific academic outcome or improvement in grades as a result of participation in the programme.

8. Limitation of Liability

To the fullest extent permitted by South African law, TMTP, its founders, tutors, and staff will not be liable for any indirect, incidental, consequential, or punitive loss or damage arising from your use of this website or participation in the programme.

TMTP's total aggregate liability for any claim arising under these terms shall not exceed R1,000 (one thousand South African Rand).

9. Photographs and Media

TMTP may photograph or record sessions, events, and student achievements for use in our communications, social media, and reports to funders. We will always obtain explicit written consent from a parent or guardian before publishing any identifiable images of minors. Adults attending programme events are deemed to consent to general photography unless they notify us otherwise.

10. Third-Party Services

This website uses third-party services including Google Maps (for location information) and analytics tools. Use of these services is subject to those providers' own terms and privacy policies. TMTP is not responsible for the availability, accuracy, or content of third-party services.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the South African courts.

12. Changes to These Terms

We may revise these terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of this website or participation in the programme after any changes constitutes your acceptance of the revised terms.
